Terms & Conditions

By using FYWY services (internet, cable TV, installation, support, website services), you agree to these Terms & Conditions and the policies listed in the menu.

This page explains the rules for using FYWY WiFi & Cable, including payments, equipment, acceptable use, and privacy.

  • Who this applies to: anyone who applies for, uses, or pays for FYWY services.
  • Updates: we may update these policies (see “Changes to Terms”).

Terms of Service

These terms govern the delivery and use of FYWY WiFi & Cable services.

Service Quality

We strive to maintain reliable service. Temporary interruptions may occur for maintenance, upgrades, or circumstances beyond our control, including:

  • Natural disasters or severe weather
  • Power outages
  • Customer equipment failure
  • Third-party network issues

Technical Support

Technical support is available to all customers. We aim to resolve service issues promptly and professionally.

Account Responsibility

Customers are responsible for providing accurate, current, and complete information when applying for and using FYWY services.

At this time, updates to account information must be made by contacting FYWY customer support. FYWY may rely on the most recent contact details provided by the customer for notices, billing, and service-related communications.

Customers are responsible for all activity conducted through their service connection or account.

Suspension or Termination of Service

FYWY reserves the right to suspend or terminate service, with or without notice, if a customer:

  • Provides false or misleading information
  • Engages in fraudulent activity
  • Tampers with, damages, or interferes with FYWY equipment or network infrastructure
  • Uses the service for illegal activities
  • Engages in repeated or serious violations of the Acceptable Use Policy
  • Uses the service in a way that negatively impacts other customers or network performance

FYWY is not responsible for illegal activities carried out by customers using the service. Where damage occurs to FYWY property or infrastructure, the customer may be charged for repair or replacement costs.

Changes to Terms & Services

FYWY conditions may change at any point, including fees and services, without prior notice. We may notify you by text, call, email, or any other reasonable method. Subject to FYWY’s right to make changes, no other statements (written or verbal) will modify this agreement.

Limitation of Liability

FYWY’s liability is limited to the amount paid for services in the month the issue occurred. We are not liable for indirect, incidental, or consequential damages resulting from service interruptions.

Governing Law & Dispute Resolution

These Terms & Conditions are governed by and interpreted in accordance with the laws of Jamaica.

In the event of a dispute, both parties agree to first attempt to resolve the matter through informal discussion and, where appropriate, mediation. Informal discussions or mediation may be conducted remotely.

If a dispute cannot be resolved through these means, either party may pursue legal action through the courts of Jamaica, which shall have exclusive jurisdiction.

Billing & Payments Policy

Payment Due Date

Payment is due on or before the 30th of each month (or at the end of the month in February).

Late / Outstanding Balances

  • Late payments may result in service disconnection.
  • Service may be terminated if monthly fees are outstanding for more than two months.

Installation Fees

Installation fees are non-refundable.

Refunds & Service Credits

Refunds or service credits for outages or service issues are handled on a case-by-case basis.

FYWY does not guarantee automatic refunds for service interruptions. Any refunds or credits granted are at FYWY’s discretion and may depend on the nature, duration, and cause of the issue.

Equipment & Installation Policy

Installation

The installation cost includes up to 150 feet of cable from the main road or main utility pole. Cable installation beyond 150 feet attracts an additional cost of $35.00 per foot (plus accessories used).

Important: On the day of installation, you must present the ID listed on your application form to the technician.

Set Top Box

Each installation includes one set top box. This set top box remains the property of FYWY and is provided under a rental agreement with a monthly rental fee.

Additional Set Top Boxes

  • Purchase Option: $7,000 (one-time payment) + $300 monthly maintenance fee
  • Rental Option: Monthly plan cost + $1,000 additional monthly rental fee

Customer Responsibility

Once equipment is placed on your premises, you are responsible for FYWY’s property and may be held liable for damage, loss, or tampering.

Disconnection & Equipment Return

  • The set top box must be returned to our office immediately after disconnection.
  • If the box is not returned, the rental fee ($300/month) will continue to be charged.
  • If service is disconnected for six months, FYWY may remove equipment from your premises.

Acceptable Use Policy

Service Restrictions

Sub-letting is prohibited: Sharing or sub-letting service to adjoining premises is prohibited and breaks our policy. Any customer found in breach may be penalized and may face immediate service termination.

Customers must not:

  • Share service with neighboring properties
  • Use excessive bandwidth in a way that significantly impacts other customers
  • Engage in illegal activities or copyright infringement
  • Tamper with or attempt to breach network security

Privacy Policy

This section explains what information FYWY collects, why we collect it, and how we protect it.

Information We Collect

  • Contact details (name, phone number, email address)
  • Service address / installation address
  • Government-issued ID and ID type (for verification and fraud prevention)
  • Billing records and payment confirmations
  • Basic service usage data for troubleshooting and network management

How We Use Information

  • To install and provide services
  • To verify identity, prevent fraud, and confirm eligibility (including age requirements)
  • To bill and process payments
  • To provide technical support and service updates
  • To improve network performance and reliability

Data Sharing

Personal information may be shared with FYWY technicians and customer service representatives solely for the purpose of installing, maintaining, and supporting services.

Payment information entered online is processed through secure third-party payment systems. FYWY does not store full card numbers or card verification values (CVV).

FYWY does not sell customer personal data.

Security

We take reasonable steps to protect customer information. However, no method of storage or transmission is 100% secure, and we cannot guarantee absolute security.

Data Retention

Customer information is retained for as long as the customer maintains an active service account, or as otherwise required for business or legal purposes.

Communications

By using FYWY services, customers consent to receive service-related communications such as billing notices, service updates, and outage notifications.

FYWY does not currently send marketing or promotional messages. If marketing communications are introduced in the future, customers will have the option to opt out while continuing to receive essential service-related notices.

Data Breach Notification

In the event of a data breach involving personal information, FYWY will notify affected customers where required by applicable law.

Your Choices

You may request access to, correction of, or deletion of your personal information where applicable. Requests can be made through FYWY support.
